Military authorization for Non EU citizens purchasing a house




In Spain there is a  regulation of areas and facilities of interest to National Defense, which develops the Law 8 /1975, and  states that to safeguard the interests of national defense , it is desirable to establish certain limitations restricting access to the property for non European Union citizens, (foreign natural or legal persons like companies)- and also Spanish companies when they attend certain characteristics.
Inclunded on these áreas there are some towns of South costa Blanca like Torrevieja, Orihuela Costa or San Miguel de Salinas.

As being restricted access areas , it provides that for the reasons stated , prohibits , restricts or conditions the acquisition of ownership and other property rights to the mentioned people , establishing a maximum rate of extension can belong in ownership or encumbered with real rights for foreigners.

According to ththis the notaries and land registries shall require the military permit prior to the granting or registration character , and necessarily must be registered in the Land Registry acts and contracts that we have been referring .



Failure to provide this military authorization , issued by the Defense Minister , they can be declared null  the public deeds of sale in the eighteen months following the operation. And it could reach even a required repeat sale if the deadline passes.

Non-EU citizens must submit to the Ministry of Defense in Madrid and military authority in their region a criminal record certificate , photocopy of passport and residence card if have it and detailed plant sketches of the house.
