Energy efficiency certificate obligation

 



The Royal Decree 235/2013 had established the obligation from the 1st of June 2013 for new constructed buildings, buildings or part of existing buildings that are rented out to a new tenant or are being sold, buildings or part of them in which a public authority occupies a useful surface or more than 250 square meters...to obtain an Energy Efficiency Certificate. This is a requirement if the property is going to be sold or rented.

In this Energy Efficiency Certificate there should be included technical, energy efficiency information and the minimum requirements regarding the energy efficiency in order to compare the property to acquire or to rent with other others similar based on a qualification and evaluation of the technical details.


The certificate has to be drawn up by a qualified technician who is in possession of the academic and professional qualifications enabling him to carry out projects or management and execution of the construction works or for the execution of projects of their heating systems, according to what is established by Law 38/1999, of management construction of the building,  (architect, technical architect or industrial engineer).

The person who is responsible to obtain the certificate is the owner of the house that is able to be rent out or to be sold. That person needs to hire a professional engineer who after visiting the house or premises, will be producing the report in which he will be including the efficiency based in the official energy scale to compare with other similar properties and the improvements to be done in case the owner wishes to upgrade the efficiency level.

It is oblige to include the Energy Efficiency Degree when the property is getting advertised to be sold, or rented out or when we are dealing with a new buyer or tenant about it, as an extra feature of the property.

The validity for the certificate is up to 10 years and in case there are changes on the property the owner can decide to be updating this if there are aspects that could be changing the energy efficiency degree.

In case of not complying with the obligation about this certificate, the sanctions could be depending on the degree (minor, severe, highly severe) up to 3005,06 € or up to 15025,30 € or up to 601012,10 €.

The engineers cost for obtaining these certificate could be between 200€ and 600€ depending on the kind of premises, total surfaces and technical aspects of the property.
